This Agreement describes the terms and conditions for your use of "Lost Times." By using our services, you agree to these terms and conditions.

Affiliate Program
You must be over 18 (eighteen) years of age to become an affiliate. You must have current membership in good standing with the NAWCC, IWJG or some other professional trade organization. Proof of membership will be required.

Fees
The annual fee for a Lost Times membership in "The Loop" is 2,000 (two thousand) dollars US, in advance. The affiliate will receive a password, which they may not disclose to any third party, enabling the placement, removal or modification of their listings. There is no limit to how many items may be placed or for how long they remain listed but you may not place an unreasonable load on our server or infrastructure. Affiliates are required to remove unavailable items promptly. The membership password is the sole property of Lost Times and may be revoked for any reason at any time. The balance of any fees paid to be returned will be calculated on a pro rata basis.

Terms
You must honor a 3 (three) day return policy. This shall begin when the buyer receives the item. If the item is returned in the same condition it was sent, you agree to fully refund buyer, less shipping, handling and credit card transaction fees, if any, within 2 (two) weeks. You must insure that your items are not counterfeit, stolen, harassing in any way, infringing upon a third parties copyright or in any way violate any law, state or federal. Your listings must not contain any viruses, Trojan horses or cookies designed to damage any computer system or gather personal information on Lost Times, its affiliates or its users. You agree not to use any devices, software or routine which prevents Lost Times from conducting business. You must maintain correct contact and inventory information. You must abide by current NAWCC or IWJG rules of business conduct.

Disclaimers
Lost Times is only a venue and cannot get involved in user to user disputes. As either an affiliate or a user of Lost Times services, you agree to release Lost Times in any dispute, claim or lawsuit and from any damages of any kind, arising for any reason. Lost Times does not confirm that each user or affiliate is who they claim to be. Though we endeavor to screen all users and affiliates, no guarantee is implied or expressed, regarding legality, safety, quality or truth in advertisement. Therefore, in high dollar or first time transactions, the use of an escrow service is suggested, such as http://www.tradesafe.com or http://www.iescrow.com. Lost Times offers all its services "as-is." We do not guarantee continuous, uninterrupted or secure access to our services as many factors not in our control may affect this. In no event shall Lost Times be liable for lost profits or any damages arising from the use of this agreement. Lost Times and you are independent contractors and no agency, partnership, joint venture, employer-employee or franchisor- franchisee relationship is implied or expressed by this agreement. Please note that some affiliates are international in origin and may evoke jurisdiction in the country of that origin in the event of any dispute or claim. All notices shall be given by email, unless otherwise stated, to the address you provide. In this case, notice shall be deemed given 24 (twenty-four) hours after email is sent. Lost Times may also give notices by prepaid certified mail and return receipt. In this case, notice shall be deemed given 3 (three) days after date of mailing.

General
This agreement shall be governed by the laws of the state of Florida. All arbitration arising from this agreement shall be conducted in the state of Florida, in Broward County. Any arbitration shall be conducted on a case by case basis and shall not be consolidated with any other claim by any other party. Limits of liability vary from state to state. If any provisions in this agreement are held to be unenforceable, the remaining provisions shall be enforced. Our failure to act on a breach by you or others does not waive our rights to future prosecution.
